End User License Agreement (EULA)
1. Acceptance of Terms
By downloading, installing, or using any applications provided by AppCityStudios (“we,” “us,” or “our”), you agree to be bound by this End User License Agreement (“EULA”). If you do not agree to these terms, do not download, install, or use our Apps.
2. License Grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a single device that you own or control and as permitted by the App Store's terms of service.
3. Restrictions
You agree not to, and will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App
- Copy, modify, adapt, translate, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the App
- Remove any copyright, trademark or other proprietary rights notices from the App
- Use the App for any illegal, unauthorized or otherwise improper purposes
4. Privacy
Our collection and use of personal information in connection with the App is as provided in our Privacy Policy available on our website. By using the App, you agree to our Privacy Policy.
5. Third-Party Services
The App may display, include or make available third-party content or services. You acknowledge and agree that we are not responsible for such content or services.
6. Updates and Maintenance
We may from time to time in our sole discretion develop and provide App updates, which may include upgrades, bug fixes, patches, and other error corrections. Updates may also modify or delete features. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features.
7. Termination
This EULA is effective until terminated by you or us. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms.
8. Disclaimer of Warranty
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
10. Governing Law
This EULA is governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law.
